1. Our approach
1.1We respect intellectual property rights and expect users to do the same. If you believe that content on the Service (for example a photo, video, article, post or story) infringes your copyright or other rights, you can ask us to remove it using this procedure. We act on valid notices expeditiously.
1.2This procedure is for intellectual property complaints. For other unlawful or harmful content use the report tools or see the KBN Social guidelines & terms; for personal data, see the Data subject requests.
↑ Contents2. How to send a notice
2.1E-mail holdingkbn@gmail.com with the subject "IP notice", or write to [to be confirmed]. Your notice must include:
- Your name, postal address, telephone number and e-mail address, and, if you act for someone else, the name of the rights holder and your authority to act.
- A description of the work or right you say is infringed (for example a link to the original, or registration details for a trade mark).
- The exact URL(s) of the content on the Service (for a post, the link from its ⋯ menu).
- Why you believe the use is not authorised by you, your agent or the law (including any exception such as quotation, criticism, review or news reporting).
- A statement that the information in the notice is accurate and that you are the rights holder or authorised to act for them.
- Your physical or electronic signature.
2.2Incomplete notices may delay action. Knowingly sending a false notice may make you liable for any damage caused.
↑ Contents3. What we do next
3.1We acknowledge valid notices within 5 working days. Where the notice is clear and valid we remove or disable access to the content, tell the person who posted it, and give them a copy of the notice (we may remove your contact details if you ask, unless the law requires otherwise).
3.2Repeated infringement leads to suspension or termination of the account.
↑ Contents4. Counter-notice
4.1If your content was removed and you believe that was a mistake or that you have the right to use it, you may send a counter-notice to the same address within 14 days, including: your name and contact details; the content removed and where it appeared; why you believe it was removed by mistake or that your use is lawful; a statement that the information is accurate; and your signature.
4.2We will send the counter-notice to the person who complained. If they do not tell us within 10 working days that they have started legal proceedings, we may restore the content. We are not a court and may decline to restore content if the position is unclear.
